Cubacenter SRL (referred to in the agreement as “we, us or our”) acts as a disclosed agent for third party visa providers (the “Supplier”). The contract for the provision of Cubacenter is between you and the Supplier.
1.1 Our registered office is Corso Europa n.38 – ZIP 24020 – Scanzorosciate (BG) – Italy. We are limited a company registered in Italy, number 384825/15.
1.2 We reserve the right to modify these terms and conditions without notice and so you should view these terms and conditions each time you visit our website.
1.3 Your use of this website signifies your agreement to these terms and conditions. They constitute a contract between you and us governing your use of this website. If you are a consumer your statutory rights are not affected by this agreement.
1.4 Please read these terms and conditions carefully before applying for tourist card/visa. By applying for tourist card/visa with us, you agree to be legally bound by these terms and conditions as they may be modified and posted on our website from time to time.
1.5 By ordering any services from our websites, you are entering into a contract with the Supplier for the supply of Services and not Cubacenter Sas. You agree to be legally bound by these terms and conditions of use as they apply to your order.
1.6 If you do not wish to be bound by these terms and conditions then regrettably you may not apply for tourist card/visa via our website.
2. Applying for Tourist Card/Visa
2.1 To apply for tourist card/visa you must follow the procedures set out on our website pages. All applications must be placed at least 10 days (delivery to Europe) or 30 days (delivery to Overseas) in advance of your departure.
2.2 We are entitled, on behalf of the Supplier, to refuse any application made by you. We do not guarantee to successfully process every request. In the event that we are unable to process your application, we will send an email to inform you about it. An alternative may be offered which may include additional charges. If your order is processed, we will acknowledge it in the e-mail address you have given us.
2.3 You confirm that all details you provide to us for the purpose of purchasing the Service from the Supplier are correct. You accept responsibility for any mistakes made on the tourist cards due to the provision of incomplete or incorrect information.
2.4 You confirm that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the Service. We reserve the right to obtain validation of your credit or debit card details before providing you with the Service. If validation cannot be obtained and payment is not made, we reserve the right to cancel the application on behalf of the Supplier concerned who will then not perform the Service.
3. Prices and Payments
3.1 Details of the prices for the Service, and the procedures for payment and delivery are displayed on our website. The applicable price of any Service is the price displayed on our website at the date and time of your order. The price of any Service on our website may change before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure (see clause 3.2 below).
3.2 We will inform you if a Service’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the Service at the correct price. If you cancel the order, you will receive a refund of all monies you have paid.
3.3 Prices quoted are per person.
3.4 You must pay by credit or debit card at the time of order as set out on the order page of our website. The cards we accept are set out on the payment page of our website.
3.5 Payments made using non-EURO credit or debit cards will be by default converted from EURO by our dynamic currency conversion service provider. If you would like that your card company does the currency conversion, please let us know in advance.
4.1 In the unlikely event of tourist visa card not arriving at its destination, the full amount will be refunded.
5. Changes and Cancellation by You.
5.1 Cuba Tourist Card/Visa is non-transferable and non-refundable once it has been issued. Any cancellation or amendment request must be sent to us in writing, by emailing email@example.com , and it will take effect from the day of receipt. Whilst we will try to assist, we cannot cancel or amend any tourist card that has already been issued. Amendments and cancellations can only be accepted in accordance with the terms and conditions.
6. Intellectual property rights.
6.1 The content of our website including without limitation all information are protected by copyright, trade marks, service marks, patents or other proprietary rights.
6.2 Except insofar as expressly permitted in these terms and conditions, the content of this website may not be retrieved, displayed, modified, copied, printed, sold, downloaded, sold, hired, reverse engineered or transmitted in any way without our prior written consent.
7. Data protection.
8.1 These terms and conditions constitute the entire agreement between you and us in connection with the use of this website. Any failure by us to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. If any part of this agreement is deemed ineffective for any reason, is deemed ineffective for any reason, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in that part and that other parts remain in full force and effect.
9. Law and jurisdiction.
9.1 This contract is governed by the law of Italy and is subject to the exclusive jurisdiction of the courts of Italy.
